AVAILABLE TO ALL BUYERS WARRANTY WHATEVER ON ALL PRODUCTS SOLD

1) SATISFACTION OR REFUND

Pursuant to Article 1 of Law 88-21 of 6 January 1988, the buyer has a period of 7 days after delivery to return the object at the following address:

the item must be returned new, in its original packaging and also with the proof of payment. The buyer will be totally refunded. The forwarding charges, remaining in this case, are at the buyer’s expense

2) GUARANTEE :

The invoice issued with the order, serves as a warranty and must be attached in case of return. We provide a guarantee for all defects of any material. The warranty is exclusively limited to repair, exchange or refund for defective item recognized by us or to the strictly extent of a defect reported in writing within 7 days after the receipt of the item.

Excluding accessories (combi, belts, shorts ...) and consumables (electrodes, cream ...) cannot be returned or exchanged for hygiene reason. For accessories a processing cost of 15 € will be charged.

3) IN ANY EVENT

The provisions do not reduce neither abolish the legal guarantee against latent defects..

4) DELIVERY

Delivery is operating only after payment receipt and registration. If, past a period of 10 days after the order, the payment failed, your order will be sent in cash-delivery.

5) AT ANY TIME

At any time, the buyer can access his/her information contained in the file of the seller.

Any discrepancies reported will be corrected immediately.

The buyer is also informed that the file provided can be marketed unless written disagreement of the buyer.

6) DEVICE REFERENCING

The designation of the device appears in your order that we recommend you to treasure, as it marks the beginning of the specific warranty.

7) DELIVERY

The delivery of these items takes place at the buyer's home or at the address of his/her choice as mentioned in the order.

8) COMMISSIONING

No commissioning is performed by the seller. The buyer will particularly ensure to :

- Check the proper functioning of the unit delivered

- Read the instructions supplied

- Examine the certificate of manufacturer's warranty if any

The buyer puts the device on by him/herself, and does so under his/her own responsibility. In case of visible defect, the buyer has the right to return the device as provided above. (Satisfied or your money back).

9) CONTRACTUAL WARRANTY

A contractual warranty is provided to the buyer on the following conditions :

- Nothing to pay in addition of the selling price unless product’s return to After Sales.

- The warranty period is 2 years (except on specific conditions)

- Starting point: the date of invoice

- The unit is repaired for free during the warranty period.

What it is meant by free guarantee :

Replacement of parts, labor, forwarding charges of the replaced device and the refund of the device in case of failure in repairing recognized by the seller or the manufacturer. (Except After Sales return)

Conditions of the contractual warranty :

The buyer must contact the customer service After Sales at info@sport-elec.com, follow the advice and apply the terms of return mentioned above, then the buyer will need to enclose in the claim a copy of the invoice.

On no account the following warranty reduces or abolishes the legal warranty against latent defects and the contractual guarantee of the manufacturer when it exists.

The forwarding charges are at the buyer’s expense.

10) LEGAL WARRANTY

It is exercised as follows :

On condition that the buyer makes the proof of the latent defect, legally, the seller has to repair all the consequences (art. 1641 of the Civil Code).

NOTE: In case of private agreement before any legal action, it is recalled that they do not interrupt the "limit period".

The amends of the consequences for latent defect, when it is proved, involve according to the case law :

- The totally free repair of the device, including labor costs and travelling expenses instead of the starting step made by the seller.

- Either its replacement or total or partial refund of the price if the device is totally or partially unusable.

- And compensation for any damage caused to persons or property because of the device defect.

The legal guarantee due to the seller does not exclude the legal guarantee due by the manufacturer.

11) POSSIBLE DISPUTES

In case of difficulty in applying these conditions, the buyer can, before any legal action, find a private agreement, with all consultant of his/her choice.

It is recalled that in general and subject to the appreciation of the courts, the contractual guarantee applies only if :

- the buyer honors its financial commitments to the seller,

- the buyer uses the machine in a normal way. For operations requiring a high technicality, third party not authorized by the seller or manufacturer can’t repair the device (except in case of force majeure or prolonged lack of the seller).

In case of disputes, only the Commercial Court of Pont-Audemer (27500) is competent

Flash Sales

General

- They are subject to French regulations on promotions, discounts and rebates.

- They are subject to stock predetermined by Sport-Elec for this purpose and are not primarily related to depletion of the stock total product.

- They are valid only on the Site www.sport-Elec.co.uk and for a stated period.

In any event the closing of the sale when the flash is effective or time dedicated stock is exhausted.

Availability

After closing a flash sale, dedicated product for this sale will not be able to be supplied to the conditions thereof.

In case of unavailability of product ordered and after completion of the sale flash Sporting Elec.co.uk send to the clients (under 72) by e-mail sent when ordering the result of a partial delivery or cancellation of the if they purchase a single product sale flash. The check will be returned when received, not made, or the levy paid by check.
